1. GENERAL PURCHASE CONDITIONS
The present General Purchase Conditions (hereinafter, GPCs) regulate the purchase of products and/or services (hereinafter, the Products) offered via the online platform/store NINSMODA, hosted in the Website www.ninsmoda-magazine.com, the ownership of which is held by EDBLAN EDITORES, S.L., with registered address at Avda. Príncipe de Asturias, 56, 08012 Barcelona and recorded in the Trade Registry of Barcelona, volume 44062, sheet 154, page 446098 and Tax Identity Number B-66184250.
As a user of NINSMODA, you acknowledge your proper legal capacity to enter into obligations and agreements regarding our Products. NINSMODA is aimed at end consumers and users, any professional activity involving the reselling or distribution of the products being forbidden.
2. REGISTER AS USER
In order to purchase via NINSMODA, it is necessary for one to be registered as a user. This registration is free of charge and one need only fill in the form included in the “Sign In/Register” section or, alternatively, perform the same process during the actual purchase. Once registered, you will receive an electronic mail confirming that your registration has been successfully completed. You may then access you account by entering your electronic mail and address and password in the registered users section.
3. PURCHASE PROCESS
3.1. Product selection. While browsing NINSMODA, you may select any of our Products. If you want to purchase a Product, you must click on “Buy”, thus directly gaining access to the Product file. By clicking on “View Order”, you will be able to check the items you have selected, their amount and their price.
You must not make any fraudulent, false or speculative orders. In such cases, we reserve the right to annul the order and/or inform the pertinent authorities if, on reasonable grounds, we suspect the order of being so. Upon making an order, you automatically agree to pay for the Products purchased via NINSMODA.
3.2. Confirmation of order. In order to complete and finish the purchase you will have to click on the checkout button. Prior to confirming your order, you will be able to verify the data of your purchase and correct any possible mistake. Confirmation of the order does not mean that it has been accepted. All orders are subject to the prior acceptance of NINSMODA.
3.3. Payment methods. Once the order has been confirmed, you may select any of the payment methods offered. The system will automatically redirect you to the chosen payment gateway. You will then have to fill in the data requested and click on the “Pay” confirmation button.
3.4. Purchase confirmation: Upon completing the purchase and clicking on the appropriate button, a confirmation will appear on screen to the effect that your purchase has been successfully carried out. NINSMODA will subsequently send you a purchase confirmation by electronic mail, with information allowing you to identify your order. At this point, we shall review your order and once this is accepted, send you an electronic mail informing you that your order is to be sent (shipping confirmation). At this stage, the Contract will have been formalised.
4. DELIVERY OF THE PRODUCTS
The subscriptions offered in NINSMODA are nationally and internationally distributed and sent by regular mail or courier service. Shipping costs are included in the prices. In some cases, the weight of the copy may exceed 500 grams, in which case you may be delivered a document to the effect that your copy is in the post office.
Subscription gifts are delivered by courier service. It is essential that the recipient provide his or her telephone number so as to ensure a successful delivery.
Other products are sent by mail or courier service, according to the characteristics of the product and the delivery address.
For shipment tracking purposes, you may send an electronic mail to our Customer Service. The orders will be sent to the delivery address provided. For security reasons, we shall accept no order if it is not possible to identify the recipient and his/her address.
NINSMODA transfers all responsibility for the products to the users once the delivery of the order has been made.
If, at the moment of acceptance of your order, we realise that one of the Products therein included is unavailable, we shall contact you via our Customer Service to inform you of this and proceed to refund the amount paid for it. Alternatively, we may inform you that this Product will soon be available in NINSMODA in case you prefer to wait and have it sent to you at a later date.
6. RETURNS AND EXCHANGES
NINSMODA has the following exchange and return policy:
1. Once the subscription or copy has been paid, should the service be cancelled for any reason, it will not be refunded. (Articles 102 and 103 “Exceptions to the right of withdrawal” Official State Bulletin-A-2014-3329).
2. Changes of address must be conveyed 30 days prior to the data of publication of the magazine.
3. Product returns or exchanges within the merchandising category:
You may return or change your purchase within a term of fifteen (15) natural days following the date of delivery of your order as long as the Products have not been used and are in perfect condition.
4. Return of erroneous or defective Products. In the event of your receiving by mistake a Product you had not ordered or a Product not in keeping with your purchase or a damaged Product, please contact us via our Customer Service and we shall duly instruct you on what to do.
In the event of any return, we shall closely examine the Product returned and convey to you by Electronic mail if the item is indeed to be returned or replaced, as applicable. The return or replacement of the item will be carried out as soon as possible, within thirty (30) natural days following the date on which we sent the electronic mail confirming the return or replacement of the item in question.
The Products must be returned in the same conditions in which they were received, along with the proof of purchase, full original packaging, labels, instructions and any related accessories.
NINSMODA will determine if the Products are in the same conditions in which they were sent. Products that have been returned damaged, incomplete, deteriorated, used or dirty will not be refunded and will be placed at your disposal and resent to you Collect on Delivery.
In the case of cosmetic, perfumery or personal hygiene products or any other products whose nature may so justify, returns will not be accepted if they have been opened and/or unsealed and/or used.
Once we have confirmed that the return is viable, in accordance with the above, you will be refunded the price paid for the products returned. The return of the amount paid will be made by the same payment method used for the purchase and within no more than thirty (30) days. Except for the return of the faulty goods, the direct costs involved in the return of the product will be at your expense.
7. PRICES AND PAYMENT METHODS. INVOICING
All prices include the legally applicable taxes (V.A.T). The price of the Products will be that in force at the moment the order is made.
At NINSMODA we try to ensure that the Product prices indicated are the correct ones. However, in the event of an error being discovered in the price of a Product you have ordered, you will be immediately notified of this and be given the option to cancel the order at no cost or confirm it at the correct price.
Shipping costs will be paid along with the payment of the corresponding price.
Once the order has been confirmed, you may select any of the payment methods placed at your disposal by NINSMODA. The payment of the corresponding amount will be made at the moment of shipping the order. Upon authorising the payment, you confirm that you are the legitimate holder of the payment medium being used. According to the banking Institution you have, the payment gateway may request more or fewer data, even the activation of the card for Internet purchases if it is not activated.
Credit cards will be subject to the verifications and authorisations of the card issuer. Should the issuer not authorise the payment, we shall accept no responsibility for any delay or non-delivery and cannot formalise any Contract with you.
Should you want us to send you an invoice, you may request this via our Customer Service and we shall send it to you within a maximum term of thirty (30) days following your purchase.

9. MODIFICATION OF THE CONDITIONS
NINSMODA is entitled to modify the GPCs at any moment. The modifications made will in no event affect the purchases made before. You will hold responsibility for becoming acquainted with the GPCs, which will be constantly available in NINSMODA and during the purchase process.
In the event of any provision of these GPCs be declared totally or partially void, invalid or ineffective on account of legislative modification, this provision will be rewritten in such a way as to reflect as much of the original intention of the Parties as is compatible with applicable law, the other GPCs remaining in full force and effect.
10. APPLICABLE LAW AND JURISDICTION
The present GPCs are subject to Spanish law. The parties, at their choice, submit to Spanish courts and tribunals for the resolution of conflicts, with express waiver of any corresponding jurisdiction.
